Personal injury legal protections for pedestrians

Pedestrian accidents can cause catastrophic injuries and harm because of the unprotected nature of pedestrian-accident victims who are vulnerable to inattentive and careless drivers on the roadways. The National Highway Traffic Safety Administration reports that 5,000 pedestrian victims die annually in fatal pedestrian accidents. During 2012, 76,000 pedestrians were injured in pedestrian accidents.

These numbers mean that many pedestrian accident victims are left suffering injuries and harm including medical expenses, lost wages and the emotional trauma oftentimes associated with a pedestrian accident. In addition, surviving family members of loved ones killed in a fatal pedestrian accident are also left with the financial and emotional damages of a pedestrian accident. Fortunately, personal injury legal protections are available to help victims and their families recover compensation for the physical, financial and emotional damages caused by a pedestrian accident.

If a driver is negligent and fails to exercise reasonable care, injuring or otherwise harming a pedestrian accident victim, they may be liable to compensate them for their damages. Drivers may be considered negligent any number of ways including if the driver was engaged in distracted driving at the time of the accident; speeding at the time of the accident; failed to yield the right of way to the pedestrian in a crosswalk; disobeyed traffic signs or signals at the time of the accident; failed to signal their intention to turn; disregarded weather, traffic or other roadway conditions; or were driving under the influence at the time they caused the pedestrian accident.

Pedestrian accident victims and their families need protections which is why the personal injury legal process is available to help. It can be essential for victims to be familiar with their rights and protections so they can focus on the challenges ahead during the recovery process.
